Welcome to the website of Alvarez Psychological Services (“the Practice,” “we,” “us,” or “our”). By accessing or using our website, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use our website or any of our services.

These Terms apply to:

  • All website visitors
  • Individuals who contact us via email, phone, or online forms
  • Prospective and current clients of clinical or forensic services

Your use of our website constitutes your acceptance of these Terms, as updated from time to time. We will post changes on this page with a new “Last Updated” date. Material changes will be emailed to active clients.

No Emergency Services

Important: This Website Is Not a Crisis Service.

If you are experiencing a mental health emergency, suicidal thoughts, or thoughts of harming others, do not use this website. Instead:

  • Call 911 immediately!
  • Go to the nearest emergency room.
  • Call the 988 Suicide and Crisis Lifeline (dial 988)

Alvarez Psychological Services does not provide emergency or crisis intervention through this website, email, or voicemail. We may not monitor these channels 24/7. In an emergency, you must seek immediate in-person or telephone crisis support.

No Psychologist-Patient Relationship by Website Use

Your use of this website, including reading content, submitting a contact form, or sending an email to Dr. Alvarez, does not create a psychologist-patient relationship.

A psychologist-patient relationship (clinical or forensic) is formed only after:

  1. You have completed an intake process (including providing necessary information)
  2. You have signed an Informed Consent for Services document.
  3. Dr. Alvarez has agreed to accept you as a client, and
  4. The first appointment has occurred (in person or by telephone, as arranged)

Until all four steps are completed, any information you share is not protected by psychologist-patient privilege. Do not send sensitive clinical or forensic details through this website or unencrypted email.

Services Offered and Important Distinctions

Alvarez Psychological Services provides two distinct categories of services. These Terms apply to both, but specific rules apply to each.

Clinical Services

Clinical services are therapeutic in nature. They include individual therapy for women experiencing depression, anxiety, trauma, relationship difficulties, career stress, and other personal challenges. In clinical services:

  • Confidentiality is protected by HIPAA and Texas law, with limits (see our Privacy Policy).
  • The goal is your personal mental health and well-being.
  • Sessions are typically 50–60 minutes.
  • Fee: $275 per hour.

Forensic Services

Forensic services are evaluative, not therapeutic. They include court-ordered psychological evaluations, parental alienation assessments, high-conflict parenting consultations, and expert witness testimony. In forensic services:

  • There is no psychologist-patient confidentiality. Information you provide may be disclosed to the court, attorneys, and opposing parties.
  • The “client” is the court, the retaining attorney, or both parents (by court order).
  • Dr. Alvarez does not serve as your therapist during a forensic evaluation.
  • Fees range from $275 – $375 per hour, depending on the service.
  • Forensic reports become court documents and are not private.

By requesting or agreeing to forensic services, you acknowledge that you have read and understood this distinction.

Fees, Payment, and Financial Policies

Hourly Rates

  • Clinical services: $275 per hour (billed in 15-minute increments after the first 60 minutes).
  • Forensic services: $275 – $375 per hour, depending on the type of service. You will receive a written fee estimate before any forensic work begins.

Payment Due at Time of Service

Dr. Alvarez does not accept or file insurance benefits. Payment is due at the time of service unless a prior written agreement states otherwise. We accept:

  • Cash
  • Check (made payable to “Mary Alvarez, Ph.D.”)
  • Credit card (in person only – we do not store card numbers online)

For forensic evaluations, a retainer may be required before work begins (typically $1,500 – $3,000). Unused retainer funds are refundable within 30 days of case closure.

Cancellation and No-Show Policy

  • 24 hours’ notice is required to cancel or reschedule any appointment (clinical or forensic).
  • Late cancellations (less than 24 hours): full fee for the scheduled session ($275 – $375).
  • No-shows (no notice): full fee plus a $50 administrative fee.
  • Exceptions: Emergencies, hospitalization, or verified family emergency may waive the fee at Dr. Alvarez’s discretion.

To cancel, call or email at least 24 hours before your appointment. Voicemail and email timestamps are accepted.

Court Appearance Fees

If Dr. Alvarez is required to appear in court (e.g., to testify, attend hearings, or provide depositions), the following applies:

  • Minimum billing: 4 hours at the forensic rate ($375/hour = $1,500 minimum).
  • Travel time (to/from court) billed at $275/hour.
  • Waiting time billed at $275/hour.
  • Preparation time (reviewing records, conferring with attorneys) billed at $375/hour.

These fees are payable in advance (retainer) or directly by the retaining attorney. The client or attorney is responsible for all court-related fees.

Record Copying Fees

You have the right to obtain a copy of your psychological records (see Privacy Policy). We charge a reasonable fee as permitted by Texas law:

  • $25 base fee for search and retrieval
  • $0.50 per page for paper copies (or $0.10 per page for digital copies)
  • Plus, actual postage if mailed.

We will respond to record requests within 30 days.

Returned Payments and Collections

If a check is returned for insufficient funds, you will be charged a $35 returned check fee. If any balance remains unpaid for more than 60 days, we may:

  • Suspend further services until the balance is paid in full.
  • Refer the account to a collection agency. You will be responsible for all collection costs, including attorney fees and court costs.

Intellectual Property Rights

All content on this website, including but not limited to:

  • Text, articles, and descriptions
  • Dr. Alvarez’s research citations and book chapters (e.g., Bernet & Alvarez, 2025)
  • Logos, graphics, and design
  • Downloadable forms (if any)

Are the property of Alvarez Psychological Services or its licensors and is protected by United States and international copyright laws.

You may not have:

  • Republish, distribute, or sell any content without our prior written permission.
  • Copy or scrape content for commercial purposes.
  • Modify or create derivative works.

You may download or print a single copy of content for your personal, non-commercial use, provided you retain all copyright and proprietary notices.

User Conduct and Prohibited Activities

When using our website or communicating with our practice, you agree not to:

  • Use the website for any unlawful purpose.
  • Harass, threaten, or abuse Dr. Alvarez or any staff (currently no staff, but applies to future employees).
  • Submit false, misleading, or fraudulent information.
  • Attempt to gain unauthorized access to our systems or data.

Limitation of Liability

To the fullest extent permitted by Texas law, Alvarez Psychological Services, Mary Alvarez, Ph.D., and any affiliated persons shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to:

In jurisdictions that do not allow the exclusion or limitation of liability, our liability is limited to the greater of $500 or the fees you paid to us in the prior six months (if any).

Indemnification

You agree to indemnify, defend, and hold harmless Alvarez Psychological Services, Mary Alvarez, Ph.D., and any future employees, contractors, or agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to:

  • Any dispute between you and another party (e.g., an ex-spouse) related to our services.

This indemnification survives the termination of these Terms and your use of the website.

Governing Law and Dispute Resolution

Governing Law

These Terms and any dispute arising out of or related to them or your use of our website or services shall be governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any federal claims shall be governed by applicable U.S. law.

 Exclusive Venue

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas. You consent to the personal jurisdiction of such courts and waive any objection based on improper venue or forum non conveniens.

Informal Dispute Resolution

Before filing any lawsuit, you agree to attempt to resolve the dispute informally by contacting Dr. Alvarez at [add email]. We will attempt to resolve the dispute within 30 days. If not resolved, you may then proceed with legal action.

No Class Actions

You agree to bring any dispute only in your individual capacity and not as a plaintiff or class member in any class, consolidated, or representative proceeding. Class arbitrations and class actions are not permitted.

Compliance with Texas and Federal Law

These Terms comply with:

  • Texas Business & Commerce Code (online contracts)
  • Texas Occupations Code Chapter 501 (psychologists)
  • Texas Administrative Code Title 22, Part 33 (Texas State Board of Examiners of Psychologists – now BHEC)
  • Health Insurance Portability and Accountability Act (HIPAA) (as it relates to our Privacy Policy, not directly to T&Cs)
  • No Surprises Act (Good Faith Estimates for uninsured/self-pay clinical services)

We are not required to collect sales tax on psychological services in Texas. If you are a business client, you must provide a valid W-9 form if requested.

Termination and Suspension

We reserve the right, without notice and in our sole discretion, to:

  • Terminate or suspend your access to our website.
  • Refuse service to anyone for any reason not prohibited by law (e.g., for abusive behavior, non-payment, or conflict of interest).

If we terminate your clinical or forensic services for cause (e.g., non-payment, threats), we will provide a termination letter and arrange for transfer of your records to another provider upon your written request and payment of record copying fees.

Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless expressly acknowledged in writing by Dr. Alvarez.

Entire Agreement

These Terms, together with our Privacy PolicyCookie Policy, and Accessibility Statement (each linked to our website), constitute the entire agreement between you and Alvarez Psychological Services regarding your use of the website. For clients, a separate Informed Consent for Services and HIPAA Notice of Privacy Practices will also apply and, in the case of conflict, the Informed Consent controls for clinical matters.
